Your access to and use of the Service is conditioned on your acceptance of and compliance with the terms. These terms are applied to all the visitors, users, and others who access or use this service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms or violate them, then you may not access the Service or a penalty will be applied.

1.0 Links to Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Pristine Nepal. However, we do not provide any links to spam websites or any corrupt websites.

Pristine Nepal has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Pristine Nepal shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

1.1 Application of these Booking Conditions

Your contract with us is subject to these booking conditions. A contract will exist between us once you have paid your deposit (or such other fee as may be appropriate, for example where you are making a ‘late booking’) and we have issued you with our booking confirmation. If any part of our contract with you is found to be invalid or unenforceable, then the remainder of it will not be affected and will remain valid and enforceable.

When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions and agree on behalf of everyone traveling in your party to be bound by them. All bookings must be made by a person aged eighteen years or over. Where your booking is for more than one person, the first-named person in your party aged eighteen years or over will be treated by us as the ‘lead name’ for your booking. The lead name will be responsible for making all payments due to us in accordance with our contract.

Completion and submission by you of our Booking Form will be treated by us as confirmation that you have read, understood and accepted these booking conditions.

1.2 Flight Cancellation during The Trip

During the trip, flights may be delayed or canceled due to bad weather or causes beyond our control. In such cases, you are responsible for covering your accommodation and food costs for the extra days. Pristine Nepal Treks assumes no responsibility or liability for any changes or modifications due to factors beyond our control.

Similarly, any expenses for accommodation, food, etc., will not be covered for any changes outside the itinerary provided by Pristine Nepal Treks.

1.3 Last hour Booking

We accept your last-hour booking on the eve of trip departure with 100% payment, 07 days before tour starting date only for Nepal Trips, but for Bhutan and Tibet trips, it will not be accepted as this requires at least 2 weeks’ payment in advance before trip departure.

1.4 Trips Cancellation Policy

After booking, some may need to cancel their trip due to personal, domestic, medical, job, or other reasons. In such cases, the following cancellation fees apply:

– A 25% cancellation fee is applied if clients notify us or our abroad agent 2 months in advance before the trip departure.

– A 50% cancellation fee is applied with 2 weeks to a month notice.

– No refund is given for last-minute cancellations or no-show situations.

However, one exception exists: if clients can provide genuine proof of why they cannot travel, their money will be held by us until they can resume their journey.

If clients need to return or leave earlier from the tour due to medical, physical, or personal reasons, they are responsible for all expenses incurred during the trekking route and at hotels in the city before their departure home.

There are no refunds if the company needs to reroute to other areas due to unavoidable circumstances. In such cases, the company assures a hassle-free rest of the adventure.

Note* We recommend clients to pay only 25% of the package through online payment system instead of paying full amount.

1.5 Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

2.0 Travel & Medical Insurance

Trekkers are required to have appropriate travel and trekking insurance or sufficient funding to cover all personal injury, death, medical expenses, and repatriation expenses (such as air ambulance or helicopter services in medical emergency situations). Additionally, they must cover all costs associated with descending, whether by horse or other means, in the event of illness

2.1 Itinerary Conditions

For all our trekking and tour itineraries, accommodations are arranged in respective hotels, lodges, home stays, guest houses, resorts, tea houses, and, in some remote areas, even camping, depending on the selected trip.

The length of each day’s trek may vary depending on the client’s fitness, porter availability, vehicle availability, flight delays or cancellations, unfavorable weather, or road and trail conditions, which are beyond our control. In such situations, the selected tour destinations may differ from the planned itineraries. In rare cases, we may need to reroute or cancel trips.

In these instances, we ask for your understanding. We will make every effort to adjust the itinerary for your convenience. The company reserves the right to cancel trips due to unavoidable conditions or circumstances beyond our control, including if the number of travelers is less than expected.

2.2 Governing Law

These terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These terms constitute the entire agreement between us regarding our service and supersede and replace any prior agreements we might have had regarding the service.

2.3 Regarding any Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

2.4 Payment of Outstanding Balance

The payment for the remaining balance of your trip can be made upon your arrival in Nepal. If you choose to settle by credit card, a handling charge of 3-4% on the outstanding balance will be added. There is no handling charge for payment by cheque or bank transfer. You are requested to deposit 25% of your package tour cost in advance.

2.5 Clients Responsibility

A tour escort/ trekking guide representing Pristine Nepal holds and deserves all authority during trekking and tours. If you exhibit negative behavior or attitudes towards guides, porters, the trekking coordinator, team members, or the local community, or if you commit any unlawful act, you will be required to leave the tour or trek immediately. No refund will be issued under such circumstances. We expect all participants to be eco-friendly and to respect the local people, their culture, and traditions in Nepal.

3.0 Data Protection

The protection of your personal information or data is extremely important to us. To respond to an inquiry, process and fulfill your booking, or send you a brochure or other promotional material, we need to collect personal data from you. We will only process your data in accordance with our Privacy Policy for or in connection with the purpose for which you have provided it (for example, arranging your trip) or as permitted by data-protection laws. You and your personal data will be protected by the EU General Data Protection Regulation (which is otherwise known as GDPR) and the Data Protection Act 2024. We refer to this legislation as data protection laws. Original Travel is a data controller of your data. We take appropriate technical and organizational measures to protect against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, which is appropriate to the harm that might result. Your personal data will be retained by us for the period referred to in our Privacy Policy.

If you have any complaints about the way in which your personal data has been dealt with, please let us know by e-mail to [email protected]. We will investigate and respond to you as soon as we reasonably can. If you remain dissatisfied, you may complain to the Information Commissioner’s Office. 

3.1 Additional Assistance

If you encounter any difficulties during your trip and require assistance, we will provide appropriate support. This includes offering information on health services, local authorities, and consular assistance, as well as assisting you in making alternative arrangements and facilitating necessary phone calls or emails. However, if the difficulty is a result of your actions, you will be responsible for covering any costs we incur in providing assistance.

3.2 Excursions

Excursions or additional trips that you choose to book or pay for while on your trip are not included in the package trip provided by us. Any excursion or tour that you book will be governed by a contract with the operator providing the excursion or tour, not with us. We are not responsible for the provision of these excursions or tours, nor for any incidents that may occur during their provision by the operators.  

3.5 No-Refund Policy

This policy outlines the terms regarding the non-refundability of fees for trekkers who are unable to complete the trek for any reason. It is the trekker’s responsibility to ensure they are physically and mentally prepared for the trek. We recommend consulting a medical professional before participating in any trek.

In rare and exceptional cases, partial refunds or credits may be considered at the sole discretion of Pristine Nepal Treks & Expedition. Such exceptions are not guaranteed and will be evaluated on a case-by-case basis.

Any costs incurred from third-party providers, such as transportation or accommodation arranged through Pristine Nepal Treks & Expedition, are also non-refundable and non-transferable, regardless of the trekker’s ability to complete the trek.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service
