You further acknowledge and agree that Pristine Nepal shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Application of these Booking Conditions

Your contract with us is subject to these booking conditions. A contract will exist between us once you have paid your deposit (or such other fee as may be appropriate, for example where you are making a ‘late booking’) and we have issued you with our booking confirmation. If any part of our contract with you is found to be invalid or unenforceable, then the remainder of it will not be affected and will remain valid and enforceable.

When you make a booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions and agree on behalf of everyone traveling in your party to be bound by them. All bookings must be made by a person aged eighteen years or over. Where your booking is for more than one person, the first-named person in your party aged eighteen years or over will be treated by us as the ‘lead name’ for your booking. The lead name will be responsible for making all payments due to us in accordance with our contract.

Completion and submission by you of our Booking Form will be treated by us as confirmation that you have read, understood and accepted these booking conditions.

Flight Cancellation during The Trip

During the trip, the flights can be delayed or canceled due to the bad weather or any cause that is beyond our control. If it happens, you have to cover up your accommodation and food costs for the extra days. Pristine Nepal assumes no responsibility or liability for any change or modifications due to the factors beyond our control.

Last hour Booking

We accept your last hour booking in the eve of trip departure with 100% payment, 07 days prior to tour starting date only for Nepal Trips, but for Bhutan and Tibet trips, it will not be accepted as this requires at least 2 weeks payment in advance prior to trip departure.

Trips Cancellation Policy

After booking, some may be compelled to cancel the trip due to personal, domestic, medical, job or some other reasons. In this case, a 25% cancellation fee is applied if the clients have notified us or our abroad agent 2 months in advance before the trip departure. 50% cancellation fee is applied on 2 weeks to a month notice. No refund on last minute or at no show situation. One exception, if you could show us some genuine proofs of why you can’t travel then your money will be with us until you resume your journey again.

If the clients have to return or break earlier from the tour due to medical/physical or personal reasons, clients have to bear all of his/her expenses occurred on the route of trekking and at hotel in the city before your home departure.

There are no refunds if the company has to reroute to other areas due to unavoidable circumstances. In such condition, the company holds the right and assures you in providing a hassle-free rest of the adventure.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Travel & Medical Insurance

Before coming for trekking in Nepal with any agencies, we recommend you to do your Travel & Medical insurance. Whereas, it should cover all the personal injury, death, medical expenses, repatriation expenses (like air ambulance or helicopter) in any on transportation and baggage loss as well.

Itinerary Conditions

In all our trekking, tour itinerary’s accommodations are all set in respective Hotels / Lodges / Home Stay/ Guest House/ Resorts, even camping in some remote areas as per the trip selected. Some of the days can be long or the others can be short depending upon client’s fitness, porter’s situation, availability of vehicle on time, flight delay/ cancellation, unfavorable bad weather or road/ trail conditions, etc. which is beyond our control. In these types of situations, selected tour destination may differ from the program itineraries. In rare cases, we might even have to reroute or cancel the trips.

In this case, please bear with us. We will try our best to adjust the itinerary trip as per your convenience. The company has the right to cancel the trips due to unavoidable condition or anything that’s beyond our control including if the volume of travelers is less than expected.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Payment of Outstanding Balance

The payment for the remaining balance of your trip can be done upon your arrival in Nepal. If you choose to settle by credit card then handling the charge of 3-4 % on the outstanding balance is added. There is no handling charge for payment by cheque or bank transfer. You are requested to deposit 20% of your package tour.

Clients Responsibility

A tour escort/ trekking guide representing Pristine Nepal holds and deserves all authority during trekking and tours. If you behave badly with a negative attitude and commit any unlawful act, you will be compelled to leave the tour/trekking. No refund will be made in such condition. Being eco-friendly and respecting the local peoples including the culture and traditions of Nepal is what we would expect from all of you.

Data Protection

The protection of your personal information or data is extremely important to us. In order to respond to an inquiry, process and fulfill your booking or send you a brochure or other promotional material, we need to collect personal data from you. We will only process your personal data in accordance with our Privacy Policy for or in connection with the purpose for which you have provided it (for example, arranging your trip) or as permitted by data-protection laws. Our Privacy Policy can be found below. Please read our Privacy Policy for full details.

You and your personal data will be protected by the EU General Data Protection Regulation (which is otherwise known as GDPR) and the Data Protection Act 2018. We refer to this legislation as data protection laws. Original Travel is a data controller of your personal data. We take appropriate technical and organizational measures to protect against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, which is appropriate to the harm that might result. Your personal data will be retained by us for the period referred to in our Privacy Policy.

 If you have any complaint about the way in which your personal data has been dealt with, please let us know by e-mail to [email protected]. We will investigate and respond to you as soon as we reasonably can. If you remain dissatisfied, you may complain to the Information Commissioner’s Office. 

Additional assistance

If you’re facing any difficulty on the trip and want to ask us to help, we will provide appropriate assistance, in particular by providing information on health services, local authorities and consular assistance; also helping you to find alternative arrangements and any necessary phone calls/emails. But you must pay any costs we incur if the difficulty is your fault.

Excursions

Excursions or other trips that you may choose to book or pay for whilst you are on trip are not part of your package trip provided by us. For any excursion or another tour that you book, your contract will be with that operator who held the excursion or tour but not with us. We are not responsible for any provision of the excursion or tour or for anything that happens during the course of its provision by those operators.

Refer a Friend

To refer a friend:
• You must have traveled with us before
• When referring a friend to us, please ensure that they quote your name at the time of enquiring for their first holiday.
• When your friend travels on their first holiday with us, you will receive a discount of $100 off on your next holiday with Pristine Nepal.
• This discount will be applied to the final balance of your next holiday with Pristine Nepal.
• Should the value of your referrals exceed the value of your Pristine Nepal Trips, you can transfer the excess value on to your next Pristine Nepal Trips.

The Friend:
• This discount only applies to your first Original Travel holiday
• The discount will be deducted from your final balance
• Only one discount can be applied
• You must quote your referrer friend’s details at the time of enquiring

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service
